Greetings all ye land owners in the great US of A.
The purpose of this blog is to discuss the varied and many rights of property ownership in the United States.
There are the fee simple owners who own all the bundle of rights. Some who have sold off some of the bundle. Some who have sold off subsurface rights.
There are many legal issues that remain unresolved. Some courts are now moving into the globalization of land rights. For instance taking away all the rights to surface and subsurface to water. In some cases the government may have a valid claim on sovereign lands and water. But when it encroaches upon the rights of property owners this is a taking and should be compensated.
First it is water they want to take. Later they will want all to control all the resources under the surface. The property owner will have no ownership except to use the surface and pay taxes as if he owns the whole bundle of rights.
There are many arguments between the surface owners and the subsurface owners. Who owns what? Who can profit from what is under the dirt, the soil, the sand?
Then there is the question if a surface owner sells off his surface, does the bottom of his pit become the new surface? And can this go on and on all the way to China?
Is there a reasonable way to determine surface ownership without taking the rights of the subsurface owner and giving them to the surface owner so he can profit from the subsurface while the subsurface owner is stripped of everything?
